KENNESAW STATE UNIVERSITY RESIDENTIAL CODE OF CONDUCT
As a resident at KSU, you assume an obligation to
conduct yourself in a manner compatible with the
university's function as an educational institution.
This
residential code of conduct defines the institution's
expectations of all residents. Any violations of these
codes of conduct will be reported to the Coordinator of
Residence Life. Jurisdiction of these violations shall
be held by the Department of Student Conduct and
Academic Integrity (SCAI) and the Vice President for
Student Success and Enrollment Services or his/her
designated representative, and handled in the manner
stipulated for non-academic grievances. All Kennesaw
State University residents shall abide by the following
rules and regulations:
1. Alcohol
Students who are of legal drinking age (21) may possess
and consume alcoholic beverages in designated
communities, but only as a private activity in private
living areas (i.e., room and/or apartment). Students are
legally responsible for their actions in all mental and
physical conditions including those induced by alcoholic
beverages. Kennesaw State University also prohibits:
a. The use or possession of alcohol by anyone under the
legal drinking age of 21;
b. The transport and/or consumption of alcohol in open
containers in any public area including any property
that surrounds an apartment and is considered
housing property;
c. The manufacture or selling of alcohol;
d. Failure to abide by the institution's policy on
student organization use of alcohol;
e. Public intoxication;
f. Common containers of alcohol (kegs, party balls,
trash cans, funnels, beer hats, etc.) are not permitted.
Beverages must be used in individual containers;
g. Guests and/or visitors consuming or possessing
alcohol in the room/apt/surrounding area of a host
(resident) under the age of 21;
h. Alcohol not being clearly consumed by those 21-years
of age or older in a room shared by students over and
under 21 years of age;
i. The use or possession of alcohol by any resident or
guest, regardless of age, in a substance-free community;
j. Being present where an alcohol violation is
occurring, regardless of whether the resident/guest is
using or possessing alcohol;
k. Alcohol paraphernalia is prohibited in substance free
communities and residential units of underage residents.
For health and safety reasons, empty alcohol containers
are not permitted to be used for decorative purposes
within the residential facilities.
2. Drugs
Kennesaw State University prohibits:
a. Selling, possessing or using any substance currently
classified as a dangerous drug by the Georgia Controlled
Substance Act or classified as illegal by state or
federal law;
b. Possession of drugs that may be used to incapacitate
other Individuals;
c. Possession and/or use of drug paraphernalia,
including but not limited to any form of bong or smoking
device, such as a hookah, even if not used or used for
tobacco products;
d. Being present where a drug-related violation is
occurring, regardless of whether the resident/guest is
using or possessing drugs.
3. Weapons
Kennesaw State University and Housing regulations
prohibit the use or possession of any weapon that can
cause bodily harm either to the bearer or another
individual. In unclear cases of definition, the context
in which a particular object was used will determine
whether it is a weapon. Items that can be easily
confused as weapons, including but not limited to
pellet, BB, paintball, or air guns, are prohibited.
4. Pets/Animals
The University does not permit students to have
pets/animals in or around the residential communities.
This includes pets belonging to outside guests; pets/
animals may not “visit” at any time. The only exceptions
are: 1. Fish in a properly maintained aquarium not to
exceed 10 gallons; and 2. Service animals
determined to be necessary for persons with
disabilities.
5. Smoking
Smoking and the use of tobacco products is prohibited
inside all residential facilities. A resident may smoke
on a private balcony (only available at University
Place) if agreed upon by all residents of the apartment.
Smoking is prohibited on all common area balconies and
stairwells. Students may only smoke outside in
designated smoking areas around the residential
communities.
6. Cooperation
Residents and guests are expected to cooperate with all
reasonable requests made by members of the community,
both on-campus and in the surrounding neighborhood.
Likewise, residents must comply with all reasonable
requests of any person acting in an official capacity as
a representative of the university, including, but not
limited to, Residence Life staff (including RAs), campus
police, faculty, and property management staff.
Cooperation includes, but is not limited to,
participating in required residential activities (i.e.,
mandatory meetings, judicial hearings, learning
communities, rules, payment of rent/fees, etc.).
Cooperation also includes compliance with all rules and
regulations established by KSU Residence Life and/or KSU
Housing not included within this code of conduct but
distributed through other printed and electronic means
(housing contract, newsletters, etc.).
7. General Safety and Well-Being
Residents are expected to take responsibility for the
overall general safety and well-being of themselves
individually and the residential community as a
collective. Engaging in any behavior that impedes the
general safety and/or wellbeing of self and/or others is
prohibited. This may include, but is not limited to;
causing physical or psychological harm to oneself and/or
others; creating an unsafe environment by leaving doors
unsecured, particularly common use doors; failing to
notify the appropriate authorities when knowledge exists
of a situation that may impede the general safety and/or
well-being of individuals and/or the community. General
safety also includes maintaining your living environment
and your own person in accordance with reasonable
health, cleanliness, and safety expectations.
8. Fire Safety
Tampering with, vandalizing or misusing fire safety
equipment is prohibited and constitutes reasons for
eviction from the apartments and possible suspension or
expulsion from the University. Fire safety equipment
includes, but is not limited to, alarms, extinguishers,
smoke detectors, door closures, alarmed doors, and
sprinklers. Failure to evacuate during a safety drill
will result in disciplinary action. Items that are
flammable such as fuel, etc., may not be stored in a
resident's room or apartment. Items that require an open
flame to operate or which produce heat (i.e., Bunsen
burners, lit candles, alcohol burners, grills) are not
allowed in resident's rooms. Residents must further
agree to abide by the safety regulations as stipulated
in the Housing Safety Regulations (located in this
handbook).
9. Noise
All students are expected to respect the rights of
others by refraining from making loud noises or causing
other disturbances that interfere with study or sleep.
a. All residents are expected to respect 24-hour
courtesy hours. If a student makes a reasonable request
of another student to be less noisy, that student
should comply. No noise should be heard outside of a
student room;
b. Quiet Hours will apply to noise regulation in the
public areas of the residential communities. Quiet Hour
adjustments may be voted on by the Community
Councils. Until this occurs, residence-wide quiet hours
will be in effect. Quiet Hours are 10pm until 10am
Sunday through Thursday and 12am to 10am Friday
and Saturday;
c. During exam periods, quiet hours will be extended to
24 hours. This regulation also applies to areas
surrounding the residential communities, and public
areas; and
d. In the event that a group makes a disturbance (e.g.,
game playing, watching TV, or yelling loudly), staff may
request violators to leave immediately.
10. Guests and Visitation
Residents may allow guests (those of the same or
opposite sex) to visit their room/apartments with
agreement from the other residents in their
room/apartment. Guests are defined as any person not
assigned to live in that specific space (even if the
person is a resident of another on-campus space).
Community Councils and roommates may develop rules that
are supplementary to but not in conflict with the
established guidelines. In order to facilitate safety
and privacy, the following are prohibited:
a. Use of the bedroom or bathroom of another resident
without his or her prior consent;
b. Guests (including other KSU students) staying in a
resident's room more than three nights within any seven
night period, staying in a resident’s room on a
frequent basis, or cohabitating in any room/apartment;
c. Proceeding or allowing guests to proceed through the
residential facilities unescorted;
d. Students are expected to accompany their guests at
all times and accept responsibility for their behavior.
At no time should any resident provide entrance
to their room to someone who is not their guest, or
provide access to a guest who is unaccompanied by the
resident (e.g., lending/copying a key or access card).
e. While hosts are held responsible for the actions of
their guests, legal action will also be taken against a
guest for violating campus policies, including but not
limited to, criminal trespass, or prosecution. Guest
must park in designated visitor spaces only, and hosts
may lose parking privileges if guests park illegally.
f. Minors who are not enrolled KSU students must be
escorted by a parent/guardian in addition to the host
resident at all times. These minors may not visit
overnight without advance permission from the Director
of Residence Life or designee.
g. General occupancy, as recommended by management and
the fire marshal, is two persons per bedroom (i.e., a
four person apartment equals a total occupancy
of eight people at any given time). Residents are
expected to comply with occupancy guidelines. Visitation
privileges may be revoked for individuals or
groups who violate the visitation policies.
11. Collective Liability/Damage and Vandalism
Residents are responsible for the condition of their
rooms and any shared spaces. While the University and
KSU Housing will strive to attribute damage and
vandalism charges to the individuals responsible, when
it cannot do so, all members of an apartment or building
may be charged equally for any damages.
Affected residents should provide information to housing
staff to assign these charges to the individual(s)
responsible. Damage, vandalism, theft, inappropriate use
of facilities, and/or use of facilities/furnishings in a
manner other than that for which they were intended, are
prohibited. There are no appeals of a Collective
Liability charge.
12. Enforcement and Grievances
Any complaints or grievances should be directed to the
respective residence hall staff member. Residents have
the right to file charges directly against another
student through the appropriate Residence Life staff
member. If the staff member cannot rectify the
situation, then the matter shall be referred through the
appropriate channels, and ultimately submitted for
action or consultations to the SCAI Department. SCAI
shall handle all matters arising from this code as any
nonacademic violation. Grievances against Residence Life
staff members shall be submitted in writing to the
Director of Residence Life.
13. Modifications and Revisions
Any modifications or revisions to these codes of conduct
shall be submitted to the Kennesaw State University
Residence Hall Association (RHA). After discussion, the
RHA shall forward its recommendations to the Director of
Residence Life. Upon his/her approval, the Director of
Residence Life shall forward the approved
recommendations to the Director of SCAI, and Vice
President for Student Success and Enrollment Services.
14. Warnings and Documented Incidents
As circumstances warrant, authorized Residence Life
and/or SCAI staff may issue warnings to students for
behaviors of concern, and violations of housing rules
and regulations, even if such behaviors do not
constitute a violation of this code. These warnings
and/or documented incidents will be recorded within the
student’s judiciary file.
15. Solicitation, Posting, and Use of Residential
Space
For the residents’ protection against fraudulent sales
and annoyance, solicitation is prohibited on university
property. Periodically special programs are offered
where residents can learn about products and services.
Residents are prohibited from engaging in business
activities on campus and in housing. All activities,
research, and postings within the residential areas must
be approved in advance by the Director of Residence Life
or designee, even if the activities/postings are
sponsored by recognized university departments or
organizations.

NOTE: Residents are
expected to abide by local, state, and federal law and
the KSU Code of Conduct, available at www.kennesaw.edu/scai.
Students are
afforded appropriate due process, including notification
of violations and judicial meetings. Notice forms
distributed at the time of violation (typically by RAs)
serve as official notice of judicial action and require
a response, typically contacting a CRL by the next
business day. CRLs adjudicate most violations and their
actions are final. More serious and repeat violations
are typically adjudicated by Student Conduct and
Academic Integrity (SCAI). Email is the official mode of
communication for KSU; therefore, all students are
expected to check their KSU student email account
regularly. While sanctions vary depending on
circumstances and severity of specific violations, KSU
reserves the right to impose a “two strike” approach and
recommend removal from housing upon a second repetitive
violation, except drug violations that result in
immediate removal.
KSU
HOUSING RULES & REGULATIONS
In addition to the Residential Code of Conduct, all
residents are expected to comply with the following
rules and regulations set forth by the Department of
Residence Life and KSUF Housing Management LLC
(hereafter referred to as KSU Housing), both of whom
reserve the right to impose independent fees and
sanctions. Violations of local, state, or federal laws
can also result in off-campus legal action.
Furniture and Fixtures: Removal of furniture from
the assigned location, except with permission, is
prohibited. Residents will also be charged for any
furniture or facilities assigned to their unit and found
missing or damaged at move-out. If common area items are
found in residents’ units, judicial action and fines
will be imposed.
Keys: Residents are provided with keys/access
cards to their units and individual bedroom. You are
responsible for your keys! Please keep them with you at
all times. Residents will be charged if keys are lost
and locks must be replaced. Residents are also charged
for lockouts. Lending your access card/keys, creating
duplicate copies and/or distribution of keys is
prohibited and can result in disciplinary action and
fines.
Mail Service: Mail is delivered to the designated
mailboxes in each community every day except Sundays and
holidays. Make sure to use your proper mailing
address provided in the move in letter, including unit
letter/number. Mail sent to the university mailroom will
not be delivered to you. Packages are accepted in the
office as a courtesy by KSUF Housing. Resident
authorizes such acceptance and releases the management
company from all liability for accepting and storing
packages. Due to the liability involved, the communities
managed by KSUF Housing will only accept packages from
the commercial delivery service (UPS, Federal Express)
etc. and United States Post Office. Packages will only
be accepted for the resident named on the Housing
Contract. Packages may only be picked up by the
individual addressed on the package. A photo ID must be
presented to pick up a package. No package will be
released without the
resident’s signature.
Maintenance Requests: To submit a request, go
online to
www.ksuhousing.com and enter the Resident
Portal. Be as detailed as possible to assist the
maintenance staff in resolving the issue. Submit routine
requests online, but for urgent and emergency needs,
contact the KSU Housing office in your community, or
call 770426-0668 after hours for facility emergencies
that cannot wait until the next day.
Move-in / Move-out Procedures: Residents are
required to follow established procedures when moving in
and out. To ensure a safe and orderly move, please
follow these procedures carefully. If you have questions
about the process, please contact KSU Housing.
Protection of Possessions: You are urged to
purchase renter’s insurance for protection against loss
or property damage, or you should check to see if you
are
covered by another homeowner’s policy. To protect your
personal possessions, we suggest the following in
addition to having insurance: lock your room and
apartment at all times; record serial numbers of your
possessions; and take valuable items with you if you are
gone for an extended period.
Recreational and Service Areas: Residents agree
to abide by additional rules and regulations established
for use of recreational and service facilities provided
by Residence Life and/or KSU Housing.
Room Entry: Residents lease ONLY their own
bedroom and a portion of the common area. Residents are
prohibited from entering any other space (vacant or
leased, locked or unlocked) without expressed approval
from the lessor of that space. Violation may result in
judicial action, substantial fines, and possible
conviction.
Room Inspection and Search Policy: KSU officials
and KSU Housing staff reserve the right to enter student
apartments under certain conditions. Entry into
occupied apartments or rooms is divided into three
categories.
A. Inspection: entry to ascertain health and safety
conditions, or to check physical
condition, typically done monthly with advance notice.
B. Search: entry for the purpose of investigating
suspected violations of University regulations and/or
city, state, or federal law. Campus authorities will not
enter the room or unit for purposes of search without
permission from the resident(s) or prior permission from
the Director of Residence Life, Vice President for
Student Success and Enrollment Services, or designees,
or in compliance with state law.
Note: Permission to search is not required when
contraband to be confiscated is in view of the
University authority. A request for permission to search
may be made when reasonable cause exists to suspect that
a violation is occurring or has occurred. A copy of the
authorization form shall be presented to the resident(s)
or left in the room/apartment if the resident(s) is
absent. The authorization form contains the place
searched, name of the person giving authorization,
descriptions of items sought, and name of requestor.
C. Emergency: entry when the delay necessary to obtain
authorization constitutes a danger to persons, property,
or the building. In such cases, campus authorities may
enter immediately.
Should a resident believe a University staff member
misused or abused his or her authority to inspect a
room, the resident should submit a written complaint to
the Director of the Residence Life or his/her designee
via email to
reslife@kennesaw.edu.
Vehicles and Parking: All residents are required
to park in the designated parking areas for each
community. Residents may park one authorized vehicle on
campus, and must register that vehicle with KSU Card
Services. A parking decal for the appropriate lot/deck
will be provided and must be displayed at all times in
the vehicle. Please note that this decal only allows
parking in the designated area and not elsewhere on
campus. Guests must park in designated guest parking,
and must comply with any designated time limits.
Recreational vehicles, boats, jet skis, etc., are
prohibited on campus. Management reserves the right to
remove or refuse parking to any vehicle, which may
endanger life or property, or is not properly maintained
or legally registered. Non-operable, abandoned, or
unauthorized vehicles will be removed by
Management at the expense of the resident or other
owner, for storage or public or private sale, at
Management’s option, and resident or owner shall have no
right of recourse against Management. Management shall
determine the definition of non-operable, abandoned, or
unauthorized vehicles.
The term “vehicle” includes, but is not limited to, both
motorized and non-motorized vehicles such as
automobiles, trucks, vans, motorcycles, boats, trailers,
campers, mobile homes, motor homes, commercial trucks,
buses, and heavy motorized or mechanized equipment or
vehicles.
An “abandoned motor vehicle” shall include, but is not
limited to, any vehicle, motor vehicle, or trailer that
has been left unattended on the community property for a
period of not less than thirty days without anyone
having made a claim. Vehicles parked in spaces with time
limits may be removed prior to thirty days.
Vehicle Maintenance
and Cleaning: Washing vehicles and performing
mechanical work is strictly prohibited on the premises
unless special areas are designated at the management’s
sole discretion.
HOUSING SAFETY REGULATIONS
General Safety: Following a few common sense
precautions can help keep our communities safe for
everyone.
− Lock your doors and vehicles at all times.
− Report suspicious persons or activities immediately.
− Be alert and take responsibility for your community.
− Do not allow strangers into your apartment/community.
− Do not be alone with people you do not know well.
− Do not put yourself into compromising situations.
Decorations: Decorative items such as fishnets,
parachutes, and other items that are flammable are not
permitted in residents’ rooms and are prohibited unless
they have been fireproofed. Only UL approved lights may
be used. Decorations may not be visible from outside the
apartment, with the exception of holiday decorations,
which must be:
− appropriate for the holiday being celebrated;
− displayed only during the time period immediately
surrounding the
− holiday;
- appropriate for a community living environment; and
− in compliance with all fire and facility regulations.
− Due to fire/facility damage risk, live cut tree are
not permitted.
− For health and safety reasons, objects once containing
food or drink
− cannot be displayed for decoration, such as empty
alcohol bottles.
Extension Cords and Multiple Plugs: An extension
cord must be UL approved, 16 gauge, and not exceed an
un-spliced length of six feet with a polarized plug and
a single outlet. It may not be placed under floor
coverings or furnishings and may not be secured by
penetrating the insulation.
Flammable Items: Items such as fuel, etc., may
not be stored in residents’ rooms or apartments.
Fire Lanes: Emergency lanes are strictly reserved
for use by emergency vehicles only. Unauthorized
vehicles parked in these areas will be towed at the
owner’s risk and expense.
Fire Equipment: Equipment is provided to monitor
fire safety conditions. Misuse of these items or other
emergency equipment constitutes a danger to the safety
of the community. Tampering with, vandalizing, or
misusing fire safety equipment is prohibited and
constitutes reason for eviction and up to expulsion from
KSU. Familiarize yourself with the location and
operation of fire equipment and evacuation routes. Fire
equipment is also located throughout the corridors and
includes, but is not limited to, alarms, extinguishers,
smoke detectors, door closures, alarmed doors, and
sprinklers. Safety drills will be conducted in
accordance with state law. Failure to evacuate when
alarms sound is grounds for disciplinary action and
fines.
Irons: Ironing is permitted, but irons must
always be used with ironing boards that have a fire
resistant cover. Irons should never be plugged in when
not in use, or left unattended. Irons with automatic
cutoff mechanisms are encouraged.
Open Flames: Items which require an open flame to
operate or which produce heat (e.g., Bunsen burners,
lighted candles, alcohol burners) are not allowed in
the facilities. Unlit candles may be used for decorative
purposes only.
Weather Safety:
KSU Police provide all guidance during weather
emergencies. Cobb County Emergency Management Agency (CEMA)
operates a Tornado siren
on campus, which is tested at noon on selected
Wednesdays. If a non-test tornado warning sounds, move
to the lowest level interior area available, stairwell,
or an interior bathroom without windows. Crouch down and
cover your head. If outside, move at right angles to the
tornado as you seek shelter.
ARCHITECTURAL STRUCTURES
Antennas: Radio/television antennas or other
objects shall not be placed or erected on the roof or
exterior of buildings.
Buildings: No defacement of the outside or inside
of any building within the communities is allowed. Such
defacement will result in fines and disciplinary action.
Balcony or Patio: The balcony or patio shall be
kept neat and clean at all times. No rugs, towels,
laundry, clothing, appliances, or other items shall be
stored, hung, or draped on railings or other portions of
balcony or patio. Outdoor furniture only is allowed on
patio/balcony. The University Village has NO balconies,
even though some units contain decorative features with
operable doors that may resemble a balcony. Storage/use
of cooking grills is not permitted on balconies or
patios. Fines will be assessed if inside furniture or
any other unauthorized items are found on the patio.
Cleaning: Residents are expected to appropriately
clean and maintain the units, including but not limited
to bathrooms, kitchens, and bedrooms. Lack of cleaning
can result in unhealthy living conditions, odor, mildew,
mold, pests, etc. Residents are expected to clean
regularly and comply with all requests made to maintain
a healthy environment. Failure to clean can result in
fines and judicial action.
Entrances, Hallways, Walks, and Grounds:
Entrances, hallways, walks, lawns, and other public
areas shall not be obstructed, used for bicycles,
motorcycles and other vehicles, or any purpose other
than ingress and egress.
Fixtures: Residents shall not display any signs,
exterior lights, or markings. No awning or other
projection shall be attached to the outside of
buildings. No satellite dish or other signal receiving
equipment may be attached to the balcony or building
exterior.
Fountains: The fountains are located on the
property for aesthetic purposes. Bubbles or soap of any
kind, gelatin, vehicles, dye, trash, or people is not
allowed in the fountains at any time. Violations will
result in disciplinary action.
Internet/Cable: Residents must not tamper with
any internet/cable wiring/ fixtures, and must comply
with all usage rules as outlined in any management
documents.
Locks: Locks may NOT be changed/installed by
residents. Locks and all original keys/key cards must be
returned upon vacating the premises, including
temporary move-outs if applicable.
Painting: Management maintains all paint and
finishes throughout the residential communities for
aesthetic consistency and appropriate condition.
Residents may not paint or alter in any way the walls or
finishes in any on-campus housing facilities.
Trash: All trash and garbage will be placed in
designated trash receptacles located in or near the
community. Residents must deposit trash and refuses
directly into designated receptacles and not leave in
the units or the common areas, hallways, balconies, or
similar places. Residents agree to place trash
Inside the receptacle, not outside the receptacle or in
the surrounding area. Management reserves the right to
impose fines for violation of this policy as well as for
littering, and residents will face judicial action.
Walkway: All walkways are intended for pedestrian
use only. No cars or motorized vehicles are allowed on
the pedestrian walkways at any time with the exception
of emergency or maintenance vehicles. Skateboards and
bicycles should be used with great caution, always
yielding to pedestrians. In additional to management and
university action, violating this policy can result in
police and legal action.
Windows and Structures: All windows and similar
structures may only be used for their intended usage,
and any safety or security devises installed must remain
in place at all times. Use of foil and other similar
unsightly materials, including but not limited to, neon
or flashing signs, advertisements on or over windows is
strictly prohibited. Windows and doors shall not be
obstructed. Management provides blinds on windows, and
such blinds shall not be removed. If residents install
draperies over the blinds, any damage will be repaired,
and draperies will be removed by residents at their own
expense. Damage to property, including but not limited
to paint, plaster, cabinets, carpets, floors, furniture
or damage to any part of the premises caused by leaving
windows or doors open during inclement weather will be
the responsibility of the residents. |
